ข้อกำหนดการใช้งาน

เมื่อท่านใช้แอป “หลวงปู่ปราโมทย์ ปาโมชฺโช” (“แอป”) หรือผู้ช่วยธรรมะ “อัญญา” (“ผู้ช่วยธรรมะ”) ถือว่าท่านยอมรับข้อกำหนดต่อไปนี้ ข้อกำหนดนี้ใช้กับแอป และกับผู้ช่วยธรรมะทั้งในแอปและบนเว็บไซต์
1. ลิขสิทธิ์และทรัพย์สินทางปัญญา
เนื้อหา ภาพ วิดีโอ หนังสือ เสียง และสื่อธรรมะทุกประเภทในแอป เป็นลิขสิทธิ์ของมูลนิธิสื่อธรรมหลวงปู่ปราโมทย์ ปาโมชฺโช (“มูลนิธิฯ”) หรือของเจ้าของสิทธิที่อนุญาตให้มูลนิธิฯ ใช้ ห้ามทำซ้ำ ดัดแปลง เผยแพร่ หรือนำไปใช้เพื่อการค้า เว้นแต่ระเบียบของมูลนิธิฯ ที่อ้างถึงในข้อ 2 อนุญาต หรือได้รับอนุญาตเป็นลายลักษณ์อักษรจากมูลนิธิฯ
2. การใช้งานที่อนุญาตและข้อห้าม
ท่านใช้แอปและผู้ช่วยธรรมะได้เพื่อประโยชน์ส่วนตัวและเพื่อศึกษาธรรมะเท่านั้น และต้องไม่ใช้เพื่อ
- กระทำการที่ผิดกฎหมาย
- รบกวนหรือทำให้ระบบเสียหาย หรือพยายามเข้าถึงระบบโดยไม่ได้รับอนุญาต
- สร้างเนื้อหาที่ทำให้ผู้อื่นเข้าใจผิดว่าเป็นคำสอนหรือคำพูดของหลวงปู่ปราโมทย์ ปาโมชฺโช
- นำสื่อของมูลนิธิฯ ไปดัดแปลงเป็นเนื้อหาที่ทำให้เข้าใจผิดหรือบิดเบือนคำสอน
ข้อห้ามสองข้อสุดท้ายครอบคลุมถึงคำตอบของผู้ช่วยธรรมะด้วย ท่านจึงต้องไม่นำคำตอบของผู้ช่วยธรรมะไปเผยแพร่ในลักษณะที่ทำให้ผู้อื่นเข้าใจว่าเป็นคำสอนของหลวงปู่ปราโมทย์ ปาโมชฺโช
หากท่านนำสื่อธรรมะของมูลนิธิฯ ไปเผยแพร่ต่อนอกแอป ท่านต้องปฏิบัติตามระเบียบการเผยแพร่สื่อธรรมะของหลวงปู่ปราโมทย์ ปาโมชฺโชด้วย ระเบียบนี้ถือเป็นส่วนหนึ่งของข้อกำหนดนี้
3. ผู้ช่วยธรรมะ (อัญญา)
ผู้ช่วยธรรมะทำงานโดยอัตโนมัติด้วยปัญญาประดิษฐ์ (AI) เป็นเครื่องมือช่วยค้นหาคำสอน ไม่ใช่คำตอบสำเร็จรูป และใช้แทนการฟังคำสอนของหลวงปู่ปราโมทย์ ปาโมชฺโช ไม่ได้ ผู้ช่วยธรรมะมีไว้สำหรับผู้ที่มีอายุ 20 ปีขึ้นไป หรือผู้ที่อายุน้อยกว่านั้นซึ่งบิดามารดาหรือผู้ปกครองรับทราบและยินยอมแล้ว
ผู้ช่วยธรรมะอ้างอิงและชี้ไปยังคำสอนของหลวงปู่ปราโมทย์ ปาโมชฺโช ที่บันทึกไว้ ผู้ช่วยธรรมะไม่สร้างเนื้อหาธรรมะขึ้นใหม่ และไม่ตีความหรือขยายความคำสอน เมื่อสรุปความ ผู้ช่วยธรรมะจะระบุแหล่งที่มาที่บันทึกไว้เสมอ
คำตอบของผู้ช่วยธรรมะ ไม่ใช่
- คำสอนอย่างเป็นทางการของหลวงปู่ปราโมทย์ ปาโมชฺโช
- ความเห็นทางธรรมอย่างเป็นทางการของมูลนิธิฯ
ก่อนนำคำตอบไปใช้ ท่านควรตรวจสอบกับสื่อธรรมะและคำสอนของหลวงปู่ปราโมทย์ ปาโมชฺโช ผ่านช่องทางที่เป็นทางการ
ผู้ช่วยธรรมะไม่ใช่บริการทางการแพทย์ บริการด้านสุขภาพจิต หรือบริการช่วยเหลือในภาวะฉุกเฉิน และใช้แทนการปรึกษาผู้เชี่ยวชาญหรือครูบาอาจารย์ไม่ได้ หากท่านหรือคนใกล้ชิดมีความทุกข์ใจรุนแรง โทรสายด่วนสุขภาพจิต 1323 ของกรมสุขภาพจิตได้ตลอด 24 ชั่วโมง หากมีเหตุฉุกเฉินที่อาจเป็นอันตรายต่อชีวิต โทรสายด่วนการแพทย์ฉุกเฉิน 1669 หรือเบอร์ฉุกเฉินในประเทศของท่าน (1323 และ 1669 เป็นเบอร์ในประเทศไทย)
ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต และภายใต้ข้อ 6 มูลนิธิฯ ไม่รับรองว่าคำตอบถูกต้องหรือครบถ้วน และไม่รับผิดต่อความเสียหายใด ๆ ที่เกิดจากการนำคำตอบไปใช้
กรุณาอย่าพิมพ์ชื่อ เบอร์โทรศัพท์ หรือข้อมูลอื่นที่บอกได้ว่าท่านหรือผู้อื่นเป็นใคร ดูรายละเอียดการจัดการข้อมูลได้ในนโยบายความเป็นส่วนตัว
4. ข้อความที่ท่านส่งให้ผู้ช่วยธรรมะ
ข้อความที่ท่านพิมพ์ยังเป็นของท่าน ท่านอนุญาตให้มูลนิธิฯ ใช้ข้อความนั้นเท่าที่จำเป็นเพื่อให้บริการผู้ช่วยธรรมะ และเพื่อตรวจสอบคุณภาพของคำตอบเฉพาะเมื่อท่านยินยอม ตามที่ระบุในนโยบายความเป็นส่วนตัว
ท่านต้องไม่ส่งข้อมูลส่วนบุคคลของผู้อื่นให้ผู้ช่วยธรรมะ
5. การให้บริการและการเปลี่ยนแปลง
มูลนิธิฯ ให้บริการโดยไม่มีค่าใช้จ่าย ตามสภาพที่เป็นอยู่ (“as is”) มูลนิธิฯ อาจปรับปรุง เปลี่ยนแปลง หรือระงับบริการส่วนใดส่วนหนึ่งได้ตามความเหมาะสม โดยไม่ต้องแจ้งล่วงหน้า
มูลนิธิฯ อาจจำกัดปริมาณการใช้งาน และอาจระงับการเข้าถึงของอุปกรณ์ที่ใช้งานผิดข้อกำหนดนี้ หรือใช้งานในลักษณะที่กระทบต่อความมั่นคงปลอดภัยหรือความพร้อมใช้งานของระบบ
6. ข้อจำกัดความรับผิด
ภายในขอบเขตสูงสุดที่กฎหมายอนุญาต มูลนิธิฯ ไม่รับผิดต่อความเสียหายทั้งทางตรงและทางอ้อมที่เกิดจากการใช้หรือการไม่สามารถใช้แอปหรือผู้ช่วยธรรมะ เว้นแต่ความเสียหายนั้นเกิดจากการฉ้อฉลหรือความประมาทเลินเล่ออย่างร้ายแรงของมูลนิธิฯ
7. เมื่อข้อกำหนดบางข้อใช้บังคับไม่ได้
หากข้อกำหนดข้อใดข้อหนึ่งใช้บังคับไม่ได้ ข้อกำหนดข้ออื่นยังคงมีผลใช้บังคับต่อไป
8. การแก้ไขข้อกำหนด
มูลนิธิฯ อาจปรับปรุงข้อกำหนดนี้เป็นครั้งคราว และจะประกาศฉบับปรับปรุงไว้ที่หน้านี้พร้อมวันที่ปรับปรุงล่าสุด หากท่านใช้งานต่อหลังจากนั้น ถือว่าท่านยอมรับฉบับปรับปรุงแล้ว
9. กฎหมายที่ใช้บังคับ
ข้อกำหนดนี้อยู่ภายใต้กฎหมายแห่งราชอาณาจักรไทย

By using the “Luangpu Pramote Pamojjo” app (“the app”) or the Dhamma assistant “Anya” (“the assistant”), you accept the following terms. These terms apply to the app, and to the assistant both in the app and on the website.
1. Copyright and intellectual property
The content, images, video, books, audio, and all other Dhamma media in the app are the copyright of Luangpu Pramote Pamojjo’s Teaching Media Foundation (“the Foundation”) or of the rights holders who have licensed them to the Foundation. You may not reproduce, modify, distribute, or commercially use them, except as permitted by the Foundation’s rules referred to in section 2 or with the Foundation’s written permission.
2. Permitted and prohibited use
You may use the app and the assistant only for personal use and for studying the Dhamma. You must not use them to:
- do anything unlawful;
- interfere with or damage the systems, or try to access them without permission;
- create content that misleads others into believing it is a teaching or statement of Luangpu Pramote Pamojjo;
- adapt the Foundation’s media into content that misleads people or distorts the teachings.
The last two prohibitions also cover the assistant’s answers. You must therefore not publish the assistant’s answers in a way that leads others to believe they are the teachings of Luangpu Pramote Pamojjo.
If you share the Foundation’s Dhamma media outside the app, you must also follow the rules for redistributing Luangpu Pramote Pamojjo’s teachings. Those rules form part of these terms.
3. The Dhamma assistant (Anya)
The assistant works automatically using artificial intelligence (AI). It is a tool to help you find the teachings, not a source of ready-made answers, and it cannot replace listening to the teachings of Luangpu Pramote Pamojjo. The assistant is for users aged 20 or over, or younger users whose parent or guardian knows and consents.
The assistant cites and points to the recorded teachings of Luangpu Pramote Pamojjo. It does not create new Dhamma content and does not interpret or expand on the teachings. When it summarises, it always cites the recorded source.
The assistant’s answers are not:
- the official teachings of Luangpu Pramote Pamojjo;
- the Foundation’s official view on matters of Dhamma.
Before you rely on an answer, you should check it against the Dhamma media and teachings of Luangpu Pramote Pamojjo through official channels.
The assistant is not a medical, mental-health, or emergency service, and it cannot replace advice from a professional or a teacher. If you or someone close to you is in severe distress, you can call the Department of Mental Health hotline on 1323, 24 hours a day. In an emergency where a life may be at risk, call the emergency medical hotline on 1669 or the emergency number in your country. (1323 and 1669 are Thai numbers.)
To the maximum extent permitted by law, and subject to section 6, the Foundation does not guarantee that answers are correct or complete, and is not liable for any damage arising from their use.
Please do not type names, phone numbers, or other details that identify you or anyone else. See the Privacy Policy for details of how data is handled.
4. Messages you send to the assistant
The messages you type remain yours. You allow the Foundation to use them as far as necessary to provide the assistant and, only if you agree, to check the quality of answers, as described in the Privacy Policy.
You must not send other people’s personal data to the assistant.
5. The service and changes to it
The Foundation provides the service free of charge and “as is”. It may improve, change, or suspend any part of the service as appropriate, without prior notice.
The Foundation may limit the amount of use. It may also suspend access from a device that is used in breach of these terms, or in a way that affects the security or availability of the systems.
6. Limitation of liability
To the maximum extent permitted by law, the Foundation is not liable for direct or indirect damage arising from the use of, or inability to use, the app or the assistant, unless the damage results from fraud or gross negligence on the part of the Foundation.
7. If a provision cannot be enforced
If any provision of these terms cannot be enforced, the other provisions remain in effect.
8. Changes to these terms
The Foundation may update these terms from time to time. It will publish each updated version on this page with a new “last updated” date. If you continue to use the service after that, you accept the updated terms.
9. Governing law
These terms are governed by the laws of the Kingdom of Thailand.
